FID before the deadline: is your storage project protected?
The AgNeS draft is not a decision. In the draft, protection under section 118 (6) of the Energy Industry Act remains only if the investment decision is taken before the planned publication. This page lists the questions. It does not give the result.
What the draft said on 7 October 2026
AgNeS, case GBK-25-01-1#3, was put out for consultation on 6 August 2026. Consultation closed on 18 September 2026. A framework decision was still expected in 2026, with publication planned in the draft for 1 January 2027. Until then it is a draft.
In the draft, the 20-year exemption under section 118 (6) no longer covers every commissioning up to 4 August 2029. It asks for a final investment decision before the planned publication and commissioning by 4 August 2029. Proof to the network operator is foreseen by 31 March 2027. The draft points to margin 17.5.
What the draft treats as an investment decision
In the draft, binding orders for at least half of the investment volume are enough, if they cannot be unwound without substantial financial loss. A grid-connection offer is, in the draft, no longer the condition. A decision taken only after publication is supposed to pay a capacity charge from 1 January 2029, even if commissioning is still inside the statutory window.
Whether your orders, contracts and resolutions meet that is not something this page can say. The case is missing, and the text is not decided. A check here means laying the papers against these draft criteria and naming gaps. It does not certify anything.
What the check is not
Not confirmation that protection exists. Not legal advice. Not a statement that publication will in fact happen on 1 January 2027. If the chamber moves the text, the dates move with it.
A reading for a specific project belongs in a mandate. The longer account is on the AgNeS page.
In the same context
The underlying reading is as of 7 October 2026. The draft is not decided. All dates are draft figures. Not legal advice.
Common questions
Has AgNeS been decided?
No. On 7 October 2026, GBK-25-01-1#3 was a draft determination. Consultation had been closed since 18 September 2026. There was no decision at that point.
By when must the investment decision be taken?
In the draft, before the planned publication on 1 January 2027, which is 31 December 2026 on the calendar, and commissioning by 4 August 2029. Proof is foreseen by 31 March 2027. Those are draft figures, not decided deadlines.
Is the grid-connection offer enough as an FID?
Under margin 17.5 of the draft, the connection offer is no longer the condition. The draft speaks of binding orders for at least half of the investment volume. Whether your papers meet that is case by case.
Do you certify the protection?
No. I lay the papers against the draft and name gaps. A statement that the exemption applies comes only from a decided text, and from the network operator.
